HighReader Terms of Use and End-User License Agreement

1. Parties, scope, and acceptance
This agreement is between you and HighGarden (the developer identified in section 9), not Apple or Google. It governs your use of HighReader and the model conditions below. Review these terms before using the app. If you do not agree to them, do not use the app. Nothing here waives rights that cannot be waived under applicable law. Your content remains yours; you must have permission or another lawful basis to import and use it.
2. App license and services
You receive a personal, non-transferable license to use HighReader on devices you own or control, subject to applicable store usage rules. For Apple devices, this includes use permitted through Family Sharing or volume purchasing. Third-party code, dictionaries, and models retain their own licenses; those licenses govern the corresponding materials and are not narrowed by this app license. Downloads and advertising may require an internet connection. Feature availability depends on the device, language resources, and installed models.
3. Content, privacy, and accuracy
HighReader processes reading and study content on your device. The separate Privacy Policy explains advertising, resource downloads, website imports, and privacy choices: https://highreader.highgarden.app/privacy.html . These terms are not consent to advertising tracking. OCR, translations, and generated speech can contain errors. Check important content against its source. You are responsible for the content you import and for how you use generated output.
4. Neural speech model conditions
HighReader uses Supertonic 3 for on-device neural speech generation. Its model weights are licensed under the BigScience Open RAIL-M License, separately from the engine source code's MIT license. Paragraph 5 and Attachment A of that model license are incorporated into this agreement as binding conditions governing your use of the model and its derivatives. You must comply with those restrictions when using them, and generated output must not be used in a way that violates the model license. These conditions also apply when a model is downloaded separately from the app.

The original use restrictions are reproduced below. They do not authorize access to or transmission of your local content. We do not claim ownership of your generated output through these terms.

Use Restrictions
You agree not to use the Model or Derivatives of the Model:
(a) In any way that violates any applicable national, federal, state, local or international law
or regulation;
(b) For the purpose of exploiting, harming or attempting to exploit or harm minors in any
way;
(c) To generate or disseminate verifiably false information and/or content with the purpose of
harming others;
(d) To generate or disseminate personal identifiable information that can be used to harm an
individual;
(e) To generate or disseminate information and/or content (e.g. images, code, posts, articles),
and place the information and/or content in any context (e.g. bot generating tweets)
without expressly and intelligibly disclaiming that the information and/or content is
machine generated;
(f) To defame, disparage or otherwise harass others;
(g) To impersonate or attempt to impersonate (e.g. deepfakes) others without their consent;
(h) For fully automated decision making that adversely impacts an individual’s legal rights or
otherwise creates or modifies a binding, enforceable obligation;
(i) For any use intended to or which has the effect of discriminating against or harming
individuals or groups based on online or offline social behavior or known or predicted
personal or personality characteristics;
(j) To exploit any of the vulnerabilities of a specific group of persons based on their age,
social, physical or mental characteristics, in order to materially distort the behavior of a
person pertaining to that group in a manner that causes or is likely to cause that person or
another person physical or psychological harm;
(k) For any use intended to or which has the effect of discriminating against individuals or
groups based on legally protected characteristics or categories;
(l) To provide medical advice and medical results interpretation;
(m) To generate or disseminate information for the purpose to be used for administration of
justice, law enforcement, immigration or asylum processes, such as predicting an
individual will commit fraud/crime commitment (e.g. by text profiling, drawing causal
relationships between assertions made in documents, indiscriminate and
arbitrarily-targeted use).
5. Responsible use and third-party terms
Use HighReader lawfully and comply with the applicable terms of third-party services and resources. Do not use the app to infringe others' rights. Read the separate attribution and license notices for dictionaries, software, and models in the app. Stopping use does not delete your local data automatically. Use the app's deletion controls when you wish to remove it, and keep your own copies of material you need.
6. Support, warranties, and claims
HighGarden is responsible for app maintenance and support required by applicable law, and for applicable app warranties. HighGarden, not Apple, handles claims relating to the app or your use of it, including product liability, compliance, consumer protection, privacy, and intellectual-property claims. HighGarden is responsible for investigating, defending, settling, and discharging third-party claims that the app infringes intellectual-property rights. No limitation in these terms excludes liability or remedies that applicable law does not allow us to exclude. Third-party model warranty provisions apply to the model as stated in its license, subject to applicable law.
7. Additional Apple terms
Apple has no obligation to provide app maintenance or support. If the app does not conform to an applicable warranty, you may notify Apple, and Apple will refund any app purchase price. To the extent allowed by law, Apple has no other warranty obligation; other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are HighGarden's responsibility. The license for Apple-branded products is subject to the Apple Media Services usage rules and does not conflict with them. Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you upon your acceptance.
8. Legal compliance and changes
You represent that you are not located in a country subject to a U.S. Government embargo or designated by it as a terrorist-supporting country, and are not on a U.S. Government list of prohibited or restricted parties. Follow applicable export and other laws. Changes to these terms will carry a new version date and be made available through the app and website. Where applicable law requires additional notice or consent, that requirement continues to apply; merely changing a web page does not override it.
